The Sites are the property of Europafilms GmbH. BY USING THE SITES AND COMMISSIONING OUR COMPANY SERVICES, YOU AGREE TO THESE TERMS OF USE; IF YOU DO NOT AGREE, DO NOT USE THE SITES OR SERVICES.

By using europafilms.com you agree to be legally bound by these terms, which shall take effect immediately on your first use of europafilms.com or europafilmschannel.com. You also agree not to adapt, alter or create a derivative work from any europafilms.com content except for your own personal, non-commercial use. Under no circumstances will Europafilms GmbH be liable for any losses or damage to data, hardware or equipment either for business or personal usage, due to any commission of works to Europafilms GmbH or use of europafilms.com.

Where you are invited to submit any contribution to europafilms.com (including any text, photographs, graphics, video or audio) you agree, by submitting your contribution, to grant Europafilms GmbH a perpetual, royalty-free, non-exclusive, sub-licenseable right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, play, make available to the public, and exercise all copyright and publicity rights with respect to your contribution worldwide and/or to incorporate your contribution in other works in any media now known or later developed for the full term of any rights that may exist in your contribution, and in accordance with privacy restrictions set out in the Europafilms GmbH Privacy Policy.

If you do not want to grant to Europafilms GmbH the rights set out above, please do not submit your contribution or commission to Europafilms GmbH or europafilms.com.

Any works commissioned and scheduled for production by Europafilms GmbH will be seen as such. In the event of any cancellations within (5) five work days of the commencement of the project, commission or it’s components, any costs will be invoiced in full. These terms remain in force, regardless to whether the project is completed or not. A reimbursement of (100%) of the total project component costs will be charged for any re-scheduling or re-booking of any commission postponed, cancelled or re-scheduled by any client within the (5) five day period. Any re-scheduling or re-booking will be seen as additional costs to the original project fees. Any donations or shares entered into by any investor are final and non-refundable.

Intellectual Property The names, images and logos identifying Europafilms GmbH or third parties and their products and services are subject to copyright, design rights and trade marks of Europafilms GmbH and/or third parties.Nothing contained in these terms shall be implied as being, or otherwise any licence or right to use any trademark, patent, design right or copyright of Europafilms GmbH, or any other third party.

If there is any conflict between these terms and specific terms appearing elsewhere on europafilms.com then the latter shall prevail. Europafilms GmbH are entitled to add to these terms and conditions at any time. If any of these terms are determined to be illegal, invalid or otherwise unenforceable by reason of the laws of any state or country in which these terms are intended to be effective, then to the extent and within the jurisdiction in which that term is illegal, invalid or unenforceable, it shall be severed and deleted from these terms and the remaining terms shall survive, remain in full force and effect and continue to be binding and enforceable.Any waiver of any provision of the Terms of Use will be effective only if in writing and signed by Europafilms GmbH. These terms shall be governed by and interpreted in accordance with the laws of Switzerland.
